Rear Extension
A party wall agreement is required when building a rear extension if the extension will be built within or adjacent to the boundary wall or structure shared with a neighbouring property. There are different notices to be served depending on the design and position of the extension.
You can build within your property and up to the boundary line, or on the boundary line so the middle of the wall is astride the boundary so that in the future the adjoining neighbour can use the wall for their own extension. Either way when excavating within 3m of your adjoining neighbour/s property and potentially going deeper than their foundations then the party wall act comes into play.

This is because the construction work may affect the structural integrity of the party wall, and therefore the rights and interests of both property owners need to be safeguarded.
The process is the same for all scenarios where the notices are served, a condition survey is completed and then a schedule of conditions is prepared along with the final award.
